LESSONS FROM THE WEB

[This column is something of a departure from the Lessons from the Web norm, in that we're asking readers to write it!]

A lot of law schools are now wired to give students Internet access in the classroom.  Indeed, being so wired is one of the criteria used by National Jurist magazine in its ranking of "Most Wired" law schools. (1)  There is at least one obvious reason not to give students Internet access during class: it gives them a very tempting distraction.  What with the lure of websites, instant messaging, email, and games, it is a wonder that students with in-class Internet access pay any attention at all.(2)  So, what use is it?  Have we set about wiring our classrooms without giving much thought to the pedagogical value of doing so? We invite readers to submit anecdotes about, examples of, and ideas for, use of student Internet access during class.

  We spend several months at Washburn discussing the issue. All our classrooms have access to the internet at the teacher's podium and an LCD projector that can project a large image of whatever is on the computer screen so the issue was strictly whether there was any pedagogical reason to have live access at students' desks. It soon became clear that there were very few reasons for having live internet access in every desk. Professors who teach research and writing clearly need it to conduct classes on internet research. Doing the research is obviously more pedagogically sound than watching someone else research. Other than that, there seemed to be no pedagogical reason to have live internet access to students' desks. However, there also seemed to be no good reason not to have it. The complain that it would be a distractor (or worse) to the students is not really a technology issue but rather a teaching or discipline issue. If the teacher makes the class experience interesting and pleasant, few if any students will need to find alternative ways of passing the time. If the teacher does not make the class interesting, internet access will simply be another way to pass the time. Early in the semester, students should be advised that a using the internet inappropriately during class will be treated as a disciplinary violation with fitting consequences. Of course, the fact that students consider internet access in the class important was also a factor. I was one of those who did not initially support the idea but eventually I understood that the advantages seemed to outweigh the disadvantages. However, at the end, the faculty voted to have it and so, far, I have not heard of major (or even minor) problems.

  Why allow for Internet access? We provide the connection but for classroom use the students are restricted to the intranet - files and exhibits placed on our local server to supplement the classroom component. The only time I have used the Internet as part and parcel of the classroom is when I have taught legal research.

  I would like to challenge the assumption that "If the teacher makes the class experience interesting and pleasant, few if any students will need to find alternative ways of passing the time. If the teacher does not make the class interesting, internet access will simply be another way to pass the time." Interesting and pleasant is relative, not absolute. Making a class more interesting and pleasant than doing a crossword puzzle is very different from making it more interesting than real time sex chat over the Internet. The Internet brings entirely new levels of distraction into the classroom. It can also undermine the Socratic dialog, for those who use it, because instant messaging allows others in the class to feed the information to the student who is reciting. I think the problem can be handled very simply: it is not very hard to set up the technology to allow the professor to either shut off the access completely, or to restrict to the school's Intranet, if you want to do exercises, but do not want to allow full access.   I have found Internet access invaluable at Buffalo and would have liked better accessibility at previous institutions where I taught. For my various classes, having Internet access has helped me integrate administrative and other practical materials into my teaching. Also it has been helpful on occasion for student participation as students have searched for materials (pertaining to the subject at hand) during classroom discussion. And of course there is no substitute for using the Internet to illustrate the facts behind a Cyberspace related case. As far as access serving as additional distraction, so be it. If students want to shortchange themselves that's their problem. I cannot say it has been a large problem so far in my classes, but I may just not have caught it. I think on net the benefits outweigh the potential distractions. The far greater danger is the use of technology as a substitute for a substantive classroom experience that inculcates legal reasoning and legal skills. I have seen no evidence of that here at UB, but at other institutions I have seen the Internet used as a classroom baby sitter and a substitute for substance and rigorous classroom preparation by a professor.

  We remodeled our classrooms a few years ago. Because of the increasing use of laptops (I estimate well over 50% now in first year classes), we provided an electric outlet for each seat so that students need not drain batteries. It probably added relatively little cost to also install internet access at the same time, so we did that as well. The access serves some useful functions. Students can check email and news or other internet sites before or after class. It also makes online research possible outside the library when the classroom is not being used, although I have seen little evidence of this use. But I have asked our administration to explore the possibility of retrofitting to enable the instructor to turn off student internet access during class because of reported abuse. The abuse goes beyond checking and sending email or checking a stock portolio performance during class. It includes instant messaging of derogatory or other inappropriate comments during class, including comments about the performance or appearance of other students in the class. I hope that the instructor's request at the beginning of the semester that students refrain from such behavior will be sufficient for most students, but, if I recall correctly, Ian Ayres reported in a New York Times article last year that he was met with student resistance to such a request. I don't have the time or desire to roam the aisles during class to see if a few students are behaving inappropriately.

  Sorry Ed, but we will have to agree to disagree on this one. As to your comment that "Interesting and pleasant is relative, not absolute. Making a class more interesting and pleasant than doing a crossword puzzle is very different from making it more interesting than real time sex chat over the Internet," my response is two fold: First, perhaps the message students are sending us by surfing or chatting rather than participating is that we need to make the classroom experience more interactive. The so-called Socratic method leaves a bunch of students out of the discussion so -- what's a 21st Century student to do? The second response is similar to Shubha's, at some point, it is up to the student and, as long as they don't distract others, one has to let them do what they will do. As to your comment that access to the internet "would undermine the Socratic dialog, for those who use it, because instant messaging allows others in the class to feed the information to the student who is reciting," I guess it doesn't bother me since I encourage my students to do just that and help each other during discussions. While I do agree with you that "the problem can be handled very simply" by having the professor be able to turn it off, the problem is that many schools are using wireless technology and I am not sure how expensive it would be to be able to turn that off.   So there's some indication that Internet access in class is useful when students are being taught legal research or are being asked to do legal research in connection with the substantive topic under consideration. Are there any other ways to take advantage of student Internet access in the classroom?

  More than aiding in doing legal research, Internet access can make legal topics more real and immediate. Instead of talking about, let's say the Antitrust Division or the PTO or the Copyright Office or a particular court as some entity out there, the institution can be brought so to speak directly into the classroom. Many of these agencies (and private organizations I might add) have useful and interactive websites that permit demonstration of a particular form or illustration of a particular process. There are also several cases where being able to show the factual elements of the case is facilitated by the Internet. What better way to demonstrate virtual search engines (to take the example of a recent case) than to go to the ditto.com web site. I think it is valuable for students to see that the law they study or the facts they are confronted with are not just abstractions. Virtual access can make the law more real, so to speak. As far as Ed's point, perhaps shutting off access is a good thing in order to remove distractions and direct attention. I don't think I can ever compete successfully with live Internet sex chat rooms (even if some of the topics I broach, if not the messenger, are deemed sexy), but I have no problem with instant messenging to clue in students for an answer. Is that not a kind of collaboration worth fostering? But then we should we remove Freecell and other games from student's hard drives before they come to class? How about not allowing gum chewing? If students are that self-destructive, well let them self-destruct.

  My sense is that we need to define the issue. As long as using the web in the classroom adds value (ie, beyond what the casebook or other reading resource provides), then employing the net in the classroom makes sense. Also, I disagree with those who assert that the distractions are the fault of ther professor. It's y/our job to use whatever means we deem apropos and then to incorporate the potential downsides in decideing whether its use in the classroom provides "value added." Having made these two observations, it is my experience that I have yet to find a valuable use for the Net DURING classtime. I use it EXTENSIVELY in my teaching--before and after class, but not during class, if for no other reason than I have yet to see the value added. I teach Civ Pro and Intl Law, which are worlds apart in terms of pedagogy, content, teaching styles, etc. So what some might consider my "shortcomings" in not using the Net DURING class has nothing to do with the subject matter.

  I recently heard that in a first- year Civil Procedure class (not mine) a student received an instant message with an attached file. When the student opened the file, the program turned off the mute function and the following audio message was loudly communicated: "Hey everybody, I'm looking at porn." Apparently, someone had a laugh, someone was embarrassed, and Civil Procedure was disrupted.

  I thought I posted a message a week or so ago to this board. It seems not to have appeared. I will repost the gist of what I said before and hope things don't get censored again. As for Blake's comments: That happened in an evening torts class at GSU a few years ago. Fortunately, it occurred during the midclass break and so it was not as disruptive. Perhaps it was just a hint that a break was needed. As for Bill's point: I commend your balanced approach to the use of technology. Too many schools seem to just jump on the technology bandwagon to make up for mediocre instruction or to get recognition on a national level which would otherwise be missing due to a lack of scholarship or vision. Technology, to repeat a what should be a cliche, is a tool, a means to an end, rather than a flashy substitute for substance.

  Thanks to everyone for your thoughtful participation (none of which was censored!). My initial question - who needs Internet access in the classroom? - was not an idle one. Here at Georgia State, where we've been something of a pioneer in the use of technology, especially the Internet, we continue to struggle with the appropriate use of technology in and out of the classroom. We are committed to the notion that the 21st-century practice will be a wired one, and that we need to do our best to prepare students for it. But the integration of technology into our teaching remains something we're learning about. I had hoped to learn of more examples of in-class student use of Internet access; perhaps they are few and far between. Thanks again for your thoughts.   From my observations, schools are not as a pioneer as they like to think. In order to use technology more effectively for teaching, faculty need to be serious teachers and scholars first. Otherwise technology just becomes a sideshow as it has at some schools including ones I have been affiliated with.

1.  The most recent appeared in March, 2001.  The ranking chart appears to be no longer available online at the National Jurist site.  Consulting our local copy of the chart confirms that "percent of classrooms with at least half of seats networked" is one of the "grading" criteria.

2.  At Georgia State, where many of our classrooms are wired for student Internet access, some of my colleagues specifically prohibit students from connecting to the Internet during class, in hopes of eliminating the distraction.
