This is an English translation of the Decision of the Commercial Court in Belgrade by which Radio B92 was taken over, i.e. by which the Director of Company "Radio B92" Sasa Mirkovic was removed from his position and certain Aleksandar Nikacevic was appointed.

Commercial court in Belgrade, judge Milena Arezina, as individual judge in court registration matter of the proposer Socially-Owned Broadcasting Enterprise "Radio B92", Belgrade, 22/V Makedonska St, for registering change of Director, has on April 1st 1999 passed

DECISION

The proposers proposition is adopted and new entry in Courts Registry is ordered, in Registry section NR. 1-13979-00, of the data conteined in attachment to the proposal NR. 4, which is a part of this Decision, so that the authorized person for representing Socially-Owned Broadcasting Enterprise "Radio B92", Belgrade, 22/V Makedonska St, is Nikacevic Aleksandar, Director, according to attachment of the decision NR. 4, and Sasa Mirkovic, Director, is erased.

This Decision is executable immediately (Art. 11 of the Law on Proceedings for Entries in the Courts Registry).

Apart from this decision, a Record of introducing new director in his duties has been made, bearing no legal relevance to the case. No explanation, grounds for decision or any other documents have been made available to Mr. Mirkovic, replaced Director, and/or his lawyers. Such breach of procedures is illegal not only in regular circumstances but also in the State of War, for no wartime Decree has foreseen the possibility of removing a Director of a Company without having to disclose him the grounds of such removal first (for the possibility of complaint).
