By court order V-Fi-2790/99, the new director of the public enterprise Radio B92 from Belgrade, Makedonska 22 was appointed and recorded in the Register.
The order was passed on April 1, 1999 and declared executive as of that day, and on April 2, 1999 the Commercial Court in Belgrade carried out the procedure of appointing the new director to the post.

Disregarding the regularity of the passed court order, the applicant states that the AUTHORIZED INDIVIDUALS OF THE COMMERCIAL COURT IN THE PROCEDURE OF APPOINTING THE DIRECTOR TO THE NEW POST, in carrying out the court order, exceeded their jurisdiction and SEALED OFF THE PREMISES OTHER THAN THOSE OF THE SUBJECT of the court order, but of another legal entity, the ASSOCIATION OF INDEPENDENT ELECTRONIC MEDIA from Belgrade, Makedonska 22, thus seriously violating the rights of this legal subject.
The premises in question (on the 10th and 11th floor of the "Dom omladine" building in Belgrade, Makedonska 22) are leased to the Association of Independent Electronic Media from Belgrade on the basis of the agreement with the Permanent Conference of Cities and Municipalities of Yugoslavia from Belgrade.
The premises of the Business Association of Independent Electronic Media are registered with this court in Belgrade, at the location of Makedonska 22/XI.

As the decisions of the court have thus prevented the applicant from carrying out his business affairs freely, as well as from accessing the seal of a legal entity, it is proposed that THIS COURT IMMEDIATELY GRANT the Association of Independent Electronic Media access to the premises that are used in a valid legal manner at the location of "Dom omladine" building on the 10th and 11th floor in Belgrade, Makedonska 22, as neither the legal entity nor the premises which are subjects of this complaint cannot be the subject of appointing the director of Radio B92, which premises are located at the 5th and 6th floor of the above mentioned building, in accordance with this court's order ref. V-Fi-2790/99.
THE COURT IS ASKED TO SETTLE THIS COMPLAINT IMMEDIATELY IN ORDER TO PREVENT THE OCCURENCE OF IRREPARABLE DAMAGE TO THE APPLICANT.
